Has anyone seen any details of Webfaction's actions to become GDPR compliant??

Our standing with GDPR is presently under review by our legal department.

We can't make any statements regarding compliance at this time,

We do expect to be compliant by the May 2018 deadline.

No, it is related to a new series of privacy laws in Europe.

My understanding is that Webfaction will be considered data processors if, for example, we're sending email through your services or storing someone's personal data with you (e.g. an email in a database for a site hosted with Webfaction). Under GDPR that means that a written contract should be in place between the data controller and yourselves so can you let us know when we can expect further information from Webfaction as it sounds as though some steps will be required on both sides before May 2018?

somehow related to the original question: will webfaction offer a real eu location (eg amsterdam or frankfurt) next year as it does not look like a smooth ride with the uk at the moment (regulatory wise)?

At this time we have no plans to do so. If that changes, we'll be sure to announce that in our blog.

From a GDPR perspective I don't see why a UK or EU location would be an issue in the short/medium term as, irrespective of Brexit, the UK is adopting GDPR like the rest of the EU.

The location of the company doesn't matter as GDPR applies to companies doing business in the EU, regardless of where they are based.

Kieren is right, we are adpoting GDPR in the UK, the only complication comes when the UK leaves and we have the ability to alter our version of GDPR as it applies to the UK.

This means that there will be two versons of GDPR that we and Webfaction will have to think about. One for businesses that are only selling to customers in the UK and another that is for companies that sell into Europe.

sorry but if you are a business inside the EU than the location does matter for GDPR. Only EU member states and a few other countries are viewed of having an adequate level of data protection at the moment.

however after the march agreement between uk & eu (transition period till end of 2020) it looks a lot better now regulatory wise and we all can be confident that the uk will be a safe third country by 2020.

more interesting is if webfaction will be gdpr compliant in the next 35 days and if we can get an signed data procressing agreement before that.

Our DPA was just uploaded and you can find it at here.

We are in the process in updating our control panel, as well as other parts of our systems, and we should have more info published in the next 48 hours.
